Insolvency and restructuring

  • Haotanto Anna Vanessa v Fang Ching Wen Ted [2022] SGHC 216 Application by a bankrupt to vary the private trustee's determination of his monthly and target contributions under s 340 of the Insolvency, Restructuring and Dissolution Act 2018; the standard of review applicable to a private trustee's determination.

  • Acted for the principal creditor, with a debt of approximately US$70 million, in the insolvency of a Singapore holding company, on issues including litigation funding under the Insolvency, Restructuring and Dissolution Act 2018 and share certificates advanced as security for lending.

  • Advised the liquidator of an insolvent Singapore-incorporated company on the recovery of transactions at an undervalue and undue preferences, in the region of US$30 million.

  • Advised a trustee in bankruptcy on a claim of approximately S$15 million founded on breach of directors' duties.

  • Acted for financial institutions in winding-up and personal insolvency proceedings arising from facilities to small and medium enterprises and from consumer and housing credit.

Commercial, company and shareholder disputes

  • Ishan Anoop Sakraney v Ameet Nalin Parikh and another matter [2021] SGHC(A) 12 Appeal to the Appellate Division of the High Court on the construction of a letter of engagement governing fee entitlement for asset-liquidation services, in proceedings commenced by originating summons.

  • Acted for a foreign party in an arbitration under the SIAC Rules 2016 seeking specific performance of a contract governed by a foreign law, valued at approximately US$170 million.

  • Acted for a minority shareholder and director in winding-up proceedings concerning a group of clinics operating under a common trade mark, with related applications for the inspection of financial records.

  • Acted for investors in a claim in misrepresentation against a Singapore company and its directors concerning the alleged award of a tender for an infrastructure project in Indonesia.

  • Acted for a party resisting the call of a performance bond by injunction under the International Arbitration Act, with parallel proceedings abroad, pending arbitration of a dispute under an engineering, procurement and construction contract.

  • Acted for a director of a trust in the recovery of funds held in an account with a private bank in Singapore, involving anti-money laundering requirements and questions of company law.

  • Advised shareholders of a private company on a prospective claim against its directors and its manager in relation to a Singapore private equity fund with capital of approximately S$90 million.

  • Acted as Singapore counsel in proceedings to enforce a Singapore civil judgment in the United Kingdom.

Insurance-backed defence and professional liability

  • Defended an insurer against a claim of approximately S$1.1 million for the cost of reinstating damaged infrastructure installations. Lead counsel

  • Defended insurers against two claims for personal injury, each of approximately S$1 million, brought against their insureds and arising from industrial lifting operations and from a motor accident. Lead counsel

  • Acted for an engineering company in the defence of a claim for breach of duty in the design and supervision of structural works, involving allegations of encroachment, water damage and declarations to the regulatory authorities. Lead counsel

  • Acted for a Singapore water transport company in the defence of proceedings under s 12(1) of the Workplace Safety and Health Act following the death of an employee.

Financial services and technology

  • Represented a young offender, under the Criminal Legal Aid Scheme, on charges under ss 3(1) and 4(3) of the Computer Misuse Act and related charges under the Penal Code, arising from unauthorised transfers from an internet banking account.

  • Advised an individual on employment, privacy and personal data matters against an international social media platform.

  • Advised a Singapore cryptocurrency company on the termination of a consulting agreement governed by Singapore law.

Matrimonial

  • AYM v AYL and another appeal [2014] SGCA 46, [2014] 4 SLR 559 Court of Appeal. Whether maintenance terms recorded in a consent order may be varied on a material change of circumstances, under ss 73 and 119 of the Women's Charter; conversion of periodic maintenance into a lump sum.
